This application has been filed by the son-in-law of the appellant stating that the appeal has abated as the sole appellant has died and in support thereof, affidavit as also the death certificate of the appellant is also annexed. Counsel representing the respondent State had also sought time to verify the correctness of the death certificate and has now stated that death of the appellant in fact has taken place and the death certificate is genuine.
The petition for treating the criminal appeal as abated is, therefore, allowed and the criminal appeal stands abated.
The report regarding verification and genuineness of death certificate be made a part of the record.
