IA No.54522/2022 – Application for Amendment of Cause Title

1. The Registry has pointed a defect in the application for amendment of cause title indicating that the petitioner was required to move an application for substitution and instead, only an application for amendment of the cause title has been filed.

2. Learned counsel urges that the sole respondent had already passed away during the pendency of the matter before the High Court and his Lrs. have been brought on record vide order dated 11th May, 2017. However, while filing the Special Leave Petition, inadvertently, the matter was filed against the dead respondent.

3. In this background, the application seeking amendment in the memo of parties has been moved.

4. For the reasons mentioned above, the office objection is overruled and the amended memo of parties is taken on record. Cause title be amended accordingly.

5. I.A. stands disposed of.

6. Office to proceed further.
