Registrar on 27.11.2013, when he was pleased to pass the following

Order:

"It is submitted that the application for impleadment has been filed by the 3rd party. Office is directed to verify it. It is submitted by Advocate Mr. Rajesh Mahale and Ms. Abha R.Sharma that though they have filed vakalatnama, they have not been served with the copy of the pleadings. The learned counsel for petitioner is directed to serve copy of the pleadings on both the counsel within two weeks and file proof. They may file their Counter Affidavit within four weeks, after the service of the pleadings. In the meanwhile, the remaining respondents may file their Counter Affidavit.

List the matter on 24.1.2014." It is submitted that show cause notice was issued to all the

common Respondents Nos. 1-174. Ms. Abha R. Sharma, Advocate has put in appearance on behalf of respondent no. 5 but counter affidavit has not been filed. M/s B.Subrahmanya Prasad and Rajesh Mahale, Advocates have put in appearance on

behalf of Respondent Nos. 26, 27, 31-33 and 1, 55 respectively but no counter affidavit filed. Mr. V.N. Raghupathy, Advocate has filed statement of objections on behalf of state of Karnataka but neither served its copy on other side advocates nor filed vakalatnama despite this Registry's letter dated 03.09.2013. Ms. Kiran Suri, Advocate has on 21.08.2013 filed vakalatnama on behalf of respondent nos. 1 in SLP (C) No. 25787/2012, respondent no. 1 in SLP No. 25850/2012 and also in respect of respondent no. 34 in SLP No. 25883/2012.

It is submitted that notice for alternative arrangement has been issued on 21.09.2013 to the aforesaid respondents as Ms. Kiran Suri, Advocate has been designated as Senior Advocate. Service of the notice for alternative arrangement is complete in respect of respondent no. 34 in SLP No. 25883/2012 (A.D. Card duly signed has been received of earlier notice but no one has appeared on his behalf) Dr.(Mrs.) Vipin Gupta, Advocate has on 17.10.2013 filed vakalatnama on behalf of respondent nos. 1 in SLP (C) No. 25787/2012 but counter affidavit has not been filed, so far. Neither A.D. Card nor unserved cover has been received in respect of respondent no. 1 in SLP No. 25850/2012 and service not complete for the said respondent. AD cards duly signed have been received from Respondent Nos. 2, 3, 5, 7-9, 10, 20, 21, 24, 25, 28, 29, 30, 37, 42, 43, 44, 45, 46-49, 52, 53, 54, 54A, 56-59, 62, 64, 66-69, 72, 73, 75, 77, 79, 81-83, 85-87, 88, 93, 95, 99, 102, 108, 109, 111, 112, 113-115, 117, 120, 121-124, 125-128, 132, 136, 138, 139, 141, 142, 144, 147-149, 152, 153, 155, 156, 158, 161, 163-165, 168, 170, 171, 172, 173 & 174 but no appearance. Neither A.D. card nor unserved cover of show cause notice has been received from Respondent Nos. 4, 6,11-19, 22, 23, 26, 27, 34, 35, 36, 38-41, 50, 51, 60, 61, 63, 65, 70, 71, 74, 76, 78, 80, 84, 89-92, 96-98, 100, 101,

103-107, 110, 116, 118-119, 129-131, 133-135, 137, 140, 143, 145, 146, 150, 151, 154, 157, 159, 160, 162, 166, 167 and 169.

It is further submitted that counsel for the petitioner has on 13.01.2014 filed objection on behalf of the petitioner to the application for intervention filed by M/s V.R. L. Logistics Ltd. but he has not served its copy to Mr. Rohit Kumar Singh, counsel for the intervenor.

It is lastly submitted that no application for impleadment has been filed by the third party. Counsel for the petitioner has not filed proof of service of copy of the pleadings to Ms. Abha R. Sharma and Mr. Rajesh Mahale, Advocates.

Service of show cause notice is not complete.
