The matter above mentioned was listed before the Hon'ble Court on 12.01.2016, when the Court was pleased to pass the following order:
"Heard the learned counsel for the petitioner and perused the relevant material. Delay condoned. Exemption from filing O.T. is granted. Issue notice. Tag with Special Leave Petition (Civil) No... CC No.6983 of 2015 and other connected cases. In the meantime, status quo with regard to possession, as it exists today, shall be maintained."
Accordingly, show cause notice was issued to all the 9 respondents on 10.02.2016 through Regd. A.D. post. A.D. Cards duly signed have been received in respect of respondent nos. 1, 3, 4 and 8 but no one has entered appearance on their behalf. Neither A.D. cards nor unserved covers have been received in respect of respondent nos. 2, 57 and 9.
Service of show cause notice is not complete on respondent nos. 2, 57 and 9.
Thereafter, the matter above mentioned along with other connected matters was listed before the Hon'ble Court on 29.03.2016, when the Court was pleased to pass the following order:
"The learned counsel for the petitioner seeks two more weeks' time to file a chart as directed by this Court on 14.10.2015.
The time, as prayed for, is granted.
The chart shall clearly indicate as to the date of taking possession and the mode of taking possession of each item of the property, if at all they have taken possession.
It shall also be indicated in the chart the mode of payment or deposit of compensation of each item.
A copy of the chart shall be furnished to the respondent on or before 10.04.2016.
In case the chart is not filed on or before 10.04.2016, it shall be presumsed that they have not taken physical possession of the property and the officers responsible for not filing the chart shall be personally made liable for the consequences.
Post on 12.04.2016 on top of the list.
In the batch, the cases shall be serially numbered while listing.
Delay condoned and issue notice in all the fresh matters returnable on 12.04.2016.
List all the matters on 12.04.2016."
Thereafter, the matter above mentioned along with other connected matters was mentioned before the Hon'ble Court on 07.04.2016, when the Court was pleased to pass the following order:
"Mr. Anup G.Chaudhary, learned senior counsel appearing for the respondents and Mr. Vishnu B. Saharya, learned counsel appearing for the petitioners have jointly mentioned these petitions and prayed for change of date of the next hearing of the matters.
As prayed for, list SLP (C) 6250 of 2015 along with all connected matters on 26.04.2016 at 02.00 PM."
It is submitted that counsel for the petitioner has on 08.04.2016 filed application for additional documents and exemption from filing Official Translation alongwith Annexure A1 to A2 as well as affidavit/chart in terms of Court's order dated 29.03.2016 and the same have already been included in the SLP paper books.
The matter above mentioned is listed before the Hon'ble Court with this office report.
