UPON hearing counsel the Court made the following O R D E R
Three weeks' time is granted as final chance to respondent Nos. 1 to 3 for filing counter affidavit. Respondent No.61 has refused to accept notice as per postal endorsement on record. It amounts to legal and valid service. Similarly, postal notice in respect of respondent No.107 has been also received with endorsement in vernacular language. Registry to take necessary steps to file the translated report on record by next date. It is pertinent to note that on behalf of respondent Nos. 75 and 78, the ld. Counsel had accepted notice and -2- Item No.61
undertaken to file vakalatnama and counter affidavit by this date but no steps have been taken and there is no compliance of the undertaking given by him. These respondents are ordered to proceed ex parte.
The ld. Counsel for the petitioner to take fresh steps against unserved respondents through the usual mode. Necessary steps be taken. List again on 6.8.2013.
