UPON hearing the counsel the Court made the following O R D E R
Office report dated 25.09.2021 records that the learned counsel for the petitioners has filed spare copies of the Special Leave Petition for issuance of notice to the proposed legal representatives of the deceased respondent Nos. 5 and 9 only on 24.09.2021. Further, application for condonation of delay has also not been filed, as a result of which, notice could not be issued.
Learned counsel for the petitioners relies on the order dated 27.04.2021 passed in Miscellaneous Application No. 66 of 2021 in Suo Motu Writ Petition No.3/2020 to state that the period of limitation has been extended by the Court.
Delay condoned.
The Registry is directed to issue notice to the proposed legal representatives of the respondent nos. 5 and 9, returnable in four weeks.
Learned counsel for the petitioners submits that he has removed all the defects in the substitution application filed in respect of Respondent No.4 and 7(2).
