It is submitted that the above mentioned Special Leave Petition is filed by Mr. Siddharth Mittal, Advocate on 30.05.2016 against the Judgment and Order dated 22.01.2016 of the High Court of Punjab and Haryana at Chandigarh in RFA Nos. 3143 & 3349 of 2009 (O & M) alongwith application for permission to file Special Leave Petition and exemption from filing official translation.
It is further submitted that Counsel for petitioner has also filed an application for substitution of deceased Petitioner No. 2 in RFA No. 3349 of 2009 namely
Pawan Kumar and Petitioner No.4 in RFA No. 3349 of 2009 namely Roshni Devi which are barred by time by 1608, and 2428 days respectively and Counsel has also filed an application for condonation of delay in filing substitution application and with prayer for setting aside abatement.
It is further submitted that Counsel for the petitioner has filed two applications for condonation of delay in filing the SLP and refiling the SLP (i) there is a delay of 39 and 36 days in filing the SLP in RFA Nos. 3143 & 3349 of 2016 respectively (ii) a delay of 64 days in refiling the SLP. There is a total delay of 103 & 100 days in filing and refiling the SLP.
It is further submitted that the instant matter is tagged with SLP (C) CC Nos. 1659716602 of 2016 Entitled Manju Deve And Ors. Etc. Vs State Of Haryana And Ors. Etc. as both are arising out of common Order.
The matter is listed before the Hon'ble Court with this office report.
