The delay of 72 days in refiling the appeal is condoned.
There is an inordinate delay of 1298 days in filing the instant appeal. We have gone through the application for condonation of delay. Sufficient cause has not been shown to condone the delay. Hence, the application for condonation of delay is rejected.
On merits also, in the facts and circumstances of the case, we find no infirmity in the impugned judgment and order.
The criminal appeal is accordingly dismissed on the ground of delay as also on merits.
