The office report on default was listed before the Hon'ble Court (in Chambers) on 22.07.2016, when the Court was pleased to pass the following order:
" In view of the office report dated 13.05.2016, two weeks' further time is granted to the learned counsel for the petitioner to do the needful, failing which, the Special Leave Petition shall stand dismissed without further reference to the Court."
It is submitted that pursuant to above order, Mr. Shankar Divate, Adv did not remove the default by taking fresh steps for service upon unserved respondent no.2 and the matter was accordingly dismissed for default.
It is further submitted that Mr. Shankar Divate, Adv for the petitioner has on 09.01.2017 filed an application for restoration of the instant matter. He has also filed spare copy for service upon the unserved respondent no.2. However, there is a delay of 142 days in filing the application for restoration and an application for condonation of delay in filing restoration has also been filed. Both the application are registered as I.A. nos. 2 and 3 respectively.
The applications in the matter above mentioned are listed before the Hon'ble Court (In Chambers).
