It has been submitted by the learned counsel for the appellants that the dispute with regard to the amount payable by the appellants is pending before the Joint Registrar of the Cooperative Societies at Bangalore in Case Application No.A(I&M):D-7:1366:2001-2001. We direct that the said case shall be decided by the Additional Registrar within six months from the date of intimation of this order to the Additional Registrar.

Till the aforesaid proceedings are completed, no coercive steps shall be taken under the provisions of the 8 Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act), for recovery of the amount.

Interim relief granted by this Court shall cease to operate when the afore-stated case is decided.

In view of the above directions, the appeals stand disposed of as allowed to the above extent with no order as to costs.

Upon hearing the learned counsel, we have learnt that the appellant has already filed an appeal before the Debts Recovery Tribunal at Ahmedabad (DRT), being Securitisation Appeal No.38 of 2001, which is pending. Similarly, the Respondent-Bank has also filed an appeal before the Gujarat State Cooperative Tribunal against order dated 4th November, 2003, passed by the learned Board of Nominees at Ahmedabad in Lavad Case No.39 of 2000.

As both appeals are pending, we would not like to entertain this appeal on merits. We direct the DRT and 10
the Gujarat State Cooperative Tribunal to decide the appeals pending before them within three months from the date of receipt of a copy of this order.

During the pendency of afore-stated appeals before the Appellate Authorities, no coercive steps shall be taken for recovery of the amount under the provisions of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act).

The question of law with regard to applicability of the SARFAESI Act, 2002 and the Multi-State Cooperative Societies Act, 2002, is kept open.

At the time of hearing of this petition, it has been submitted that Petitioner No.1 has already filed an appeal before the Debt Recovery Appellate Tribunal at Chennai (DRAT) and the said appeal, being AIR (SA) 230/2011, is pending. In the afore-stated appeal an interim order had been passed whereby the petitioner had been directed to pay Rs.65 lakhs (Rupees sixty five lakhs) by way of pre-deposit. At that stage, Writ Petition No.367/2011 had been filed in this Court. In pursuance of an interim order passed by this Court, a sum of Rs.2 crores (Rupees two Crores) has been paid by the petitioners to the respondent-Bank and the said amount has been kept in a separate account by the respondent-Bank. 12 2. As the petitioners have already paid more than Rs.65 lakhs (Rupees sixty five lakhs), we direct that the amount which has been deposited in a separate account by the
respondent-Bank, shall be appropriated towards the dues of
the petitioners.

It would not be necessary for the petitioners to pay a further sum of Rs.65 lakhs as directed by the Tribunal. The Tribunal shall decide the appeal which is pending before it, preferably within three months from the date of receipt of a copy of this order. During the pendency of afore-stated appeal before the DRAT, no coercive steps shall be taken for recovery of the amount under the provisions of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act).

Heard the learned counsel.
The learned counsel for the petitioner would like to file reply to I.A.No.2/2015 (For directions) filed by the Respondent-Creditor.
He may file the same within two weeks from today. The ad-interim relief granted on 29.10.2012 is modified to the effect that the petitioners shall pay 25% of the amount payable as on 01.01.2015 as calculated by the respondent-Bank or the assignee of the debt, who has been impleaded as party-respondent, within six weeks from today and further 25% of the amount within six weeks thereafter.
If the amount is not paid, as directed hereinabove, the interim relief granted in favour of the petitioners shall stand vacated.

It has been submitted by the learned counsel for the appellant that the appellant had borrowed money from nine different Cooperative Banks. Out of the nine Banks, eight Banks have already been paid their dues and as far as the 9 th 31
