O R D E R
This is a petition filed under Section 25 of the Code of Civil Procedure, 1908 (for short "CPC"). The petitioner is the wife of the respondent. The petitioner has filed this Transfer Petition seeking the following reliefs:
- "(a) Allow the present Transfer Petition and transfer the petition filed by the Respondent bearing Civil Proceeding No.212 of 2023 under Section 9 of the Hindu Marriage Act, 1955 titled, "Shri Anand Satapathy v. Smt. Gitanjali Satapathy" from the Court of Ld. Family Judge, Ganjam at Behrampur, Odisha to the Court of Ld. Principal and Family Judge, Surajpur Courts, Gautum Budh Nagar, Uttar Pradesh; and
- (b) Pass any other and further order or orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case and in the interest of justice."
We have heard learned counsel for both the parties.
Having heard learned counsel for the petitioner and on perusal of the material on record, we find that the petitioner has made out a case for transfer of the aforesaid petition.
**In the result, the Transfer Petition is allowed and the petition bearing Civil Proceeding No.212 of 2023 titled "**Anand Satapathy v. Gitanjali Satapathy" pending before the Family
Judge, Ganjam at Behrampur, Odisha is ordered to be transferred Digitally signed by Signature Not Verified
to the Family Judge, Surajpur Courts, Gautum Budh Nagar, Uttar Date: 2024.11.07 12:07:40 IST Reason:
