The Civil appeal above mentioned was listed before the

Hon'ble Court with other connected matters on 09/12/2016 for

pronouncement of Judgment today, When the Hon'ble Court was

pleased to pass the following order:-

" Hon'ble Mr. Justice Dipak Misra pronounced the judgment of the Bench comprising His Lordship, Hon'ble Mr. Justice Amitava Roy and Hon'ble Mr. Justice A.M. Khanwikar.

In view of the signed reportable judgment, the civil appeals are maintainable. Let the appeals be listed at 3 p.m. on 15th December, 2016, for further orders.

Interim order passed on 18th October, 2016 to continue. "

CIVIL APPEAL NO. 2453 OF 2007.

It is submitted that Mr. Ajit S. Bhasma, Advocate has on 4/2/2011 filed an application for recall/modification and restoration of Court's order dated 18/10/2011 passed in I.A. No.13/2009 (Registered I.A. No.14). Copy of the same has been placed with I.A. No.13 / 2009 paper book. Counsel for the appellant has on 21st July, 2016 filed application for taking on record additional documents alongwith affidavit (Regd. I.A. No.23). Copies of the same have been placed with appeal paper books.

It is further submitted that there are four respondents in this appeals. All the respondents are represented by their respective advocates.

CIVIL APPEAL NO. 2456 OF 2007.

It is submitted that Mr. B. Balaji, Advocate has on 09/12/2016 filed application for additional documents and Mr.V.N.Raghupathy, Advocate has on 14/12/2016 filed application of the State of Karnataka to take on record the factual position emerging from the orders of this Hon'ble Court (Regd. I.A. No.19&20/2016). Copies of the applications are being circulated with office report for kind perusal of the Hon'ble Court.

It is further submitted that there are three respondents in this appeal and all are represented by their respective advocates.

It is also submitted that Ms. Aparna Bhat, Advocate has on 19th September, 2016 filed an application for intervention to allow the applicant to intervene in this appeal (Regd.I.A. No.13/2016). Ms. Supreeta Sharanagouda, Advocate has on 24/09/2016 filed an application for intervention to allow the S. Suresh and Ors. are applicants to intervene in this appeal (Regd. I.A. No.14/2016). Copies of the both application have been placed with appeal paper books for kind perusal of the Hon'ble Court with this office report.

It is lastly submitted that the instant appeal has been tagged with Original Suit No. 3 of 2001 (Main matter of Section III-A.),Civil appeal No. 2453 of 2007 (XIV) and Civil appeal No. 2454/2007 (Section XII), instead of sending Original record a letter dated 22/06/2009 has been received from Cauvery Water Dispute Tribunal, Govt. of India, Ministry of Water resources stating therein that Original record consists of statement of cases, Counter affidavits and rejoinders followed by evidence and final arguments which run into thousands of pages. Counsel for the appellant has on 25/06/2013 filed Contempt Petition (Civil) alongwith Annexures A to I alongwith Vakalatnama and Memo of appearance in the appeal above mentioned and registered as Contempt Petition (Civil) No. 225 of 2013. Copy of the Contempt Petition has been placed with appeal paper books. Contd...3/=

It is lastly submitted that Review Petition (Civil) No.3662 of 2016 in Civil Appeal No. 2456 of 2007 was listed by way of circulation before the Hon'ble Judge in Chamber on 06/12/2016 (Copy of Court's order placed with appeal paper books), when His Lordship pleased to pass the following order:-

" List the review petition in the open Court on 11th January, 2017."

Civil appeal No. 2454 /2007 is related with Section XII.

The Civil appeals alongwith applications above mentioned are listed before the Hon'ble Court with this Office Report.
