CIVIL APPEAL NO 2453 OF 2007.

The application for direction dated 21.07.2014 filed on behalf of respondent No.1 by Mr. B. Balaji, Advocate was listed before the Hon'ble Court on 8/8/2014 with office report dated 6th August, 2014, When the Hon'ble Court was pleased to pass the following order:-

"List the matter before a Bench of which Hon'ble Mr. Justice Kurian Joseph and Hon'ble Mr. Justice Rohinton Fali Nariman are not the members."

It is submitted that Mr. Ajit S. Bhasma, Advocate has on 4/2/2011 filed an application for recall/modification and restoration of Court's order dated 18/10/2011 passed in I.A. No.13/2009 (Registered I.A. No.14). Copy of the same has been placed with I.A. No.13 / 2009 paper book. Mr.Ramesh Babu M.R., Advocate on behalf of the the State of Kerla has on 11/11/2014 filed reply affidavit in application for direction No. 19 of 2014 filed by state of Tamil Contd...2/=

Nadu. Counsel for the respondent No.1 has on 18th November, 2014 filed an application for directions (Regd. I.A. No.20.) and he has on 26th March, 2015 filed an additional affidavit alongwith application for taking on record additional affidavit in I.A. No.20 (Regd. I.A. No.21). Mr. V.G. Pragasam, Advocate has on 01/02/2016 filed application for direction on behalf of Union Territory of Puducherry (Regd. I.A. No.22.) Copies of the same have been placed with appeal paper books.

It is further submitted that there are four respondents in this appeals. All the respondents are represented by their respective advocates.

It is also submitted that Counsel for the appellant has on 5th October, 2015 filed Counter affidavit on behalf of state of Karnataka to I.A. No. 20/2014 filed by State of Tamil Nadu. Copy of the same has been placed with respective I.A. 20 Paper books.

CIVIL APPEAL NO. 2456 OF 2007.

The appeal with Original Suit No. 3 of 2001 (Main matter in Group) were listed before the Hon'ble Court on 15/01/2014 with office report dated 8th January, 2014, when the Hon'ble Court was pleased to pass the following order:-

"List this group of matters "For Directions on March 12, 2013."

It is submitted that there are three respondents in this appeal and all are represented by their respective advocates.

It is further submitted that Counsel for the appellant has on 11/11/2013, 11/4/2014 and on 17/10/2015 filed application for directions in this appeal. (Registered as I.A. Nos. 7/2013, 8/2014 and 9 of 2015). Counsel for the respondent No.1 has on 4 th January, 2014 filed reply of I.A. No.7 and counsel for the appellant has on 17th April, 2014 filed rejoinder affidavit in I.A. No.7. Copies of the same have been placed with their respective paper books.

It is also submitted that Counsel for the respondent No.1 has on 17th November, 2015 filed statement of objections on behalf of the respondent No.1 i.e. state of Karnataka in I.A. No.9/2015 filed by State of Tamil Nadu. Counsel for the appellant has on 10/02/2016 filed response of State of Tamil Nadu to the Objections filed by State of Karnataka. Copies of the same have been placed with respective I.A. No.9/2015 Paper books.

It is further submitted that Counsel for the appellant has on 25/06/2013 filed Contempt Petition (Civil) alongwith Annexures A to I alongwith Vakalatnama and Memo of appearance in the appeal above mentioned and registered as Contempt Petition(Civil) No. 225 of 2013. Copy of the same has been placed with appeal paper books.

It is lastly submitted that the instant appeal has been tagged with Original Suit No. 3 of 2001 (Main matter of Section III-A.), instead of sending Original record a letter dated 22/06/2009 has been received from Cauvery Water Dispute Tribunal, Govt. of India, Ministry of Water resources stating therein that Original record consists of statement of cases, Counter affidavits and rejoinders followed by evidence and final arguments which run into thousands of pages.

Civil appeal No. 2454 /2007 is related with Section XII.

The Civil appeals alongwith applications above mentioned are listed before the Hon'ble Court with this Office Report.
