The matters above mentioned were listed before the Hon'ble Court on 22.02.2016 when the Court was pleased to pass the following order:-

"Delay in filing and refiling the Special Leave Petitions is condoned on the condition that the petitioners, in the event of enhancement being given, shall not be entitled for any statutory benefits for the period covered by the delay. Issue notice."

It is submitted that as directed above, show cause notice to both the Respondents (common in both SLPs) was issued on 03.03.2016 by Regd. A.D. M/s Saharya & Co., Advocate has on 28.03.2016 filed vakalatnama on behalf of Respondent NO. 2 but has not filed counter affidavit so far. No one has entered appearance on behalf of respondent No.1 though served.

For non-filing of counter affidavit by the counsel appearing for the respondent no.2 and non appearance of respondent no.1, the matters were lastly listed before the Court of Ld. Registrar on 26.07.2016 and lastly on 06.09.2016 when he was pleased to pass the following order:-

"Four weeks time, as last chance is given to the respondent No.2 to file the counter affidavit. After expiry of four weeks, list the matter before the Hon'ble Court."

It is further submitted that counsel for the respondent No.2 has not filed counter affidavit so far.

Service is complete.

The matters above-mentioned are listed before Hon'ble Court with this Office Report.
