Issue notice to the Officer of the petitioner -Company who has sworn the affidavit of urgency to explain as to how the pendency of the proceedings under Section 391 of the Companies Act, 1956 before the Bombay High Court would be a justification for taking up this matter out of

turn particularly as the present matter relates to the entitlement of the petitioner to a decree on admission under Order XII rule 6 of the Code of Civil Procedure, 1908.

The matter will be heard after the ensuing summer vacation.
