Service has been effected on both the respondents. Notwithstanding the service, the 1st respondent has chosen not to appear.
Issue fresh notice to 1st respondent, returnable on 07.08.2023.
The 1st respondent shall explain why it did not appear before this Court, after service of notice.

In fact, in the pre-arrest bail application before the High Court, CBI was the 1st respondent. However, instead of CBI, the petitioner has made the State of Uttar Pradesh as a party respondent.
We direct the petitioner to amend the cause title by deleting the State of Uttar Pradesh by impleading the Central Bureau of Investigation as 1st respondent.
Let amended cause title be filed within one week.
Issue notice to 1st respondent CBI, returnable on 07.08.2023.
