UPON hearing the counsel the Court made the following O R D E R

This is an application seeking modification of the order dated 09.01.2023 requiring the petitioners to deposit 50 percent of the ARF demanded for the disputed period with a request to the High Court to conclude the proceedings on merits within a period of three months.

Learned counsel for the petitioners contends that although a statement to deposit 50 percent of the ARF demanded for the disputed period was made but on account of the fact that the petitioners have also to pay ARF for the current year which is approximately 30 crores and as such they would not be in a position to deposit the 50 percent as directed by this Court and thus, they seek waiver of the said condition.

We are further informed that 27.03.2023 date is fixed before the High Court for final disposal.

In view of the facts and circumstances noted hereinabove, the condition to deposit 50 percent of the ARF demanded for the disputed period is waived.

We request the High Court to decide the petition filed by the present petitioner(s) on its own merits without insisting for any deposit.

With the aforesaid observations, the miscellaneous application(s) stands disposed of.
