O R D E R

This appeal by special leave is directed against the judgment and order dated 22.11.2006 passed by the High Court of Judicature at Andhra Pradesh in Criminal Appeal No.222 of 2006 whereby the High Court dismissed the appeal filed by the appellant herein.

It is submitted by the learned counsel for the appellant that the appellant has already undergone 15 years of actual sentence. It is surprising that even though the appellant has undergone 15 years of actual sentence, the State has not considered the case of the appellant for premature release, nor the appellant has made any representation to the State.

Taking into consideration the aforesaid fact, we direct the appellant to make a representation to the Government of Telangana seeking remission in accordance with the Rules applicable to the State of Telangana. directed to consider the same within a period of two months from the date of making such representation, and release the appellant, in accordance with the Remission Rules of the Government of Telangana, if not required in any other case.

With the aforesaid observations, without going into the merits of the case, we dispose of this appeal.

However, if the case of the appellant is not considered by the Government of Telangana within the aforesaid period or if the Government of Telangana rejects the representation of the appellant, the appellant is at liberty to make an application before this Court for restoration of the appeal.
