CORAM :
HON'BLE MR. JUSTICE ABHAY S. OKA
Mr. Pallav Mongia, AOR For Parties(s) Mr. Ankush Mangal, Adv. Mr. Nitish Banka, Adv. Mr. Praveen Swarup, AOR
UPON hearing the counsel the Court made the following $0 R D E R$
The learned counsel appearing for the petitioner-wife seeks time to file reply to I.A. No. 141007/2021, which is an application randed by the respondent-husband seeking vacation of stay granted by this Court vide order dated 27th August, 2019 in T.P.(Civil) No. 2078 of 2019.
However, the learned counsel appearing for the petitioner does not dispute that during the pendency of the petition, the petitioner-wife has shifted to U.S.A and now, at present, the petitioner-wife is residing in U.S.A.
This Transfer Petition (Civil) No. 2078 of 2019 proceeds on the footing that the petitioner-wife, being a resident of Kurnool, Andhra Pradesh, finds it inconvenient to attend the pending Divorce Petition filed by the respondent-husband in the Family Court, R.R. District at Malkajgiri, Telangana.
It was the duty of the petitioner-wife herself to bring the subsequent events to the notice of this Court. However, she has failed to do so.
Therefore, while granting time of six weeks to the learned counsel appearing for the petitioner-wife to file a reply to the I.A. No. 141007/2021**, I make it clear that the interim relief granted by this Court on 27th August, 2019 stands vacated.**
List both the petitions in the third week of July, 2022.
