The matter abovementioned was listed before the Ld. Registrar Court on 14.03.2016, when he was pleased to pass the following order:

"Respondent Nos. 1 and 34 have failed to file the counter affidavit within the peiod stipulated in the order dated 16.07.2015 of the Hon'ble Court. Four weeks time is given to the respondent Nos. 3 and 35 to file the Counter affidavit. Four weeks time is given to the learned counsel for the petitioners for filing the affidavit in proof of dasti service of notice already issued to

the respondent Nos. 2, 4 to 33 and 36.

List again on 3.5.2016."

It is submitted that there are total 43 respondents in this matter. Mr. Rupesh Kumar, Advocate for respondent No. 1. Mr. Ankur Sood, Advocate for respondent No. 3 and Mr. Irshad Ahmed, Advocate for respondent No. 35 has not filed counter affidavit. Mrs. Sushma Suri, Advocate for respondent No. 33 and 34 has filed an application for deletion of names of the said respondents, which has been regitered as I.A. No. 4, put in Chamber Pool and is yet to be listed before the Hon'ble Judge in Chambers. Service on respondent Nos. 2, 4, 6, 7, 8, 12 to 14, 16 to 20, 23, 25, 26, 2830, 31, 3740 and 42 is complete by AD Cards but no one has entered appearance on their behalf. The Advocate for the petitioner has not filed affidavit of dasti service in respect of

unserved respondent Nos. 5, 9 to 11, 15, 21, 22, 24, 27, 32, 36, 41 and 43 so far. Unserved cover has been received from respondent No. 5 with postal remarks "refused to receive".

It is further submitted that the District & Session Judge, New Delhi District vide letter dated 16.3.2016 (F/A) has stated that respondent No. 43 has refused to received the notice.

The Service is incomplete on respondent Nos. 9 to 11, 15, 21, 22, 24, 27, 32, 36 and 41; and R.No.5 and 43 have refused to accept the notice.

The matter abovementioned is listed before the Ld. Registrar Court with this office report.
