The matter above mentioned was listed before the Ld. Registrar on 06.07.2015 when the following order was passed :

"Counter affidavit on behalf of respondent Nos. 1 to 11 and 13 and 16 of SLP(C) No. 9454/2015, on behalf of respondent Nos. 13 to 16 in SLP(C) No. 9455/2015 is awaited.

The Ld. Counsel for respondent Nos. 1 to 4, 5, 8, 10, 11 and 14 to 16 in the first matter has mentioned that complete set of pleadings has yet not been received, despite the repeated requests and reminders in this respect to the petitioner. However, the Ld. Counsel for the petitioner has mentioned that complete set of the pleadings has been provided to the Ld. Counsel appearing on behalf of the other respondents. One week's time is requested to provide the complete set of the pleadings to the said respondents as well. Counter affidavit be filed within four weeks thereafter.

With respect to the remaining unserved respondents, petitioner still to take fresh steps to effect the service.

Respondent No. 1 of the second matter is reported to have expired. The Ld. Counsel for the petitioner to take appropriate steps to substitute the legal representatives.

List again on 02.09.2015."

It is submitted that counsel for the petitioner has not filed the proof of serving the pleading on the respondents so far.

It is further submitted that counsel for the petitioner has not taken steps to effect the service on unserved respondent Nos. 12, 1719 in SLP(C) No. 9454 of 2015. He has also not taken steps to bring on record the LRs. of deceased respondent No. 1 in SLP(C) No. 9455 of 2015.

It is lastly submitted that Mr. Ashok Kumar Singh, Advocate has filed counter affidavit on behalf of Respondent Nos. 1, 2, 4, 5, 8, 10, 14 & 16. But the same is defective for the reason that he has not served its copy on Mr. Abhinav Mukherji, Advocate for respondent Nos. 3, 6, 7 & 13 and page nos. against the annexures are also not mentioned.

Service of show cause notice is not complete on respondent Nos. 12, 1719 in SLP(C) No. 9454 & respondent No. 1 in SLP(C) No. 9455 of 2015.

The matters are listed before the Ld. Registrar's Court with this office report.
