The Writ Petition above-mentioned was listed before the learned Registrar's Court on 12.08.2015 with Office Report dated 11.08.2015, when she was pleased to pass the following Order:-
"Counter affidavit on behalf of respondent Nos. 9, 19, 20,30, 32 and 33 is already on record.
Rest of the appearing counsel for the respondents are at liberty to file the counter affidavit, who have yet not filed the same, within four weeks, as last opportunity.
Counter affidavit on behalf of respondent No.4 has already been filed but it remains defective. Four weeks' time is granted to cure the defects.
The Ld. Counsel for the petitioner to take fresh steps for effecting service upon respondent Nos.14 to 16, 18, 24, 25, 28 and 29 within four weeks.
Service is complete on respondent Nos.5, 8, 17, 31, 35 and 36 but no one has put in appearance. List again on 12.10.2015."
Pursuant to above Order, fresh Show Cause Notice was issued to Respondent Nos. 14 to 16, 18, 24-25 and 28-29 through registered A.D on 21.08.2015. But Neither A.D. Card nor unserved envelope containing the notice has been received back so far.
It is next submitted that Mr. Shailesh Bagoli, Secretary-in-charge, Uttarakhand Administration has sent a letter dated 22.09.2015 stating therein that Mr. J.K. Bhatia, Advocate has been appointed in the instant writ petition on behalf of State of Uttarakhand, i.e. Respondent No. 28, but no Vakalatnama/Appearance has been filed on behalf of the State of Uttarakhand, so far.
