WRIT PETITION (C) NO. 817 AND 824 OF 2016:

The Writ Petitions above-mentioned were listed before the Hon'ble Court on 17.10.2016, when the Court was pleased to pass the following order:

"Tag with S.L.P.(C) No. 15482 of 2016 and other connected matters."

It is further submitted that Writ Petitions above-mentioned were listed before the Hon'ble Court on 24.10.2016 with other connected matters, when the Court was pleased to pass the following order:

"We have perused the office report dated 22nd October, 2016. It appears that except respondent No. 3 in SLP(C) No. 18128 of 2016 service on rest of the respondents in all the special leave petitions is complete. We take the service be completed on all the respondents. List these matters for final disposal on a non-miscellaneous day in the month of January, 2017. All contesting respondents are permitted to file response affidavits."

It is submitted that pursuant to afore-said order, no response affidavits have been filed so far.

W.P.(C) No. 1017 of 2016:

It is submitted that the matter above-mentioned was listed before the Hon'ble Court on 03.01.2017, when the Court was pleased to pass the following Order:

"Issue notice. Tag with W.P.(C) No. 824/2016."

It is further submitted that pursuant to afore-said order, counsel for the petitioners has filed a letter dated 06.01.2017 stating that he has filed five spare copies for issuance of notice to respondent Nos. 1 to 5 only. For respondent Nos. 6 to 1428, an application for seeking permission for substituted service through newspaper publication will be filed soon. (Copy of letter is enclosed herewith). Accordingly, notice was issued to respondent Nos. 1 to 5 by speed post on 07.01.2017.

It is further submitted that notice has been delivered on all the five respondents as per the tracking information of the postal authorities. However, no one has entered appearance so far though served with notice.

Service of notice is complete on respondent nos. 1 to 5.

W.P.(C) No. 9 of 2017:

It is submitted that the matter above-mentioned was filed by Mr. F.I. Choudhury, Advocate on behalf of the petitioner.

It is further submitted that SLP(C) CC NO. 19071 of 2016 between the same parties arising out of similar issue was rejected by this Hon'ble Court on 28.10.2016. (Copy of order dated 28.10.2016 is annexed as Annexure P-11 at page No. 246 in the paper books).

It is further submitted that SLP(C) No. 32728 of 2015 arising out of similar issue was disposed of by this Hon'ble Court on 16.03.2016. (Copy of order dated 16.03.2016 is annexed as Annexure P-10 at page Nos. 240-245 in paper books).

It is further submitted that W.P.(C) No. 1017 of 2016 arising out of similar issue is pending and the same was listed before the Hon'ble Court on 03.01.2017, when the Court directed to issue notice and tag the matter with W.P.(C) No. 824 of 2016 (Copy of order dated 03.01.2017 is enclosed herewith).

It is further submitted that counsel for the petitioners has given a letter dated 16.12.2016 regarding certain defects raised by the Registry. (Copy of the same is annexed at page No. 247 in the paper books).

It is further submitted that the matter above-mentioned was mentioned before the Hon'ble Court on 06.01.2017, when the Court was pleased to pass the following Order:

"Post along with the connected matters, as per the list provided by the learned counsel, i.e., the matters mentioned at serial no. 242 of the Advance List – AL 7/2017."

It is lastly submitted that pursuant to afore-said order, instant matter has been tagged with SLP(C) No. 15482 of 2016 etc.

W.P.(C) No. 22 of 2017:

The writ petition above-mentioned was listed before the Hon'ble Court on 16.01.2017, when the Court was pleased to pass the following Order:

"Issue notice. Tag with W.P.(C) No. 817/2016 and connected matters."

It is submitted that counsel for the petitioner has not filed spare copies of the writ petition to serve the notice to the respondents. Hence, show cause notice could not be issued.

Service of notice is not complete.

The Writ Petitions above-mentioned are listed before the Hon'ble Court with this Office Report.
