Heard Mr. Maninder Singh, learned Additional Solicitor General appearing for the appellants. None appears for the respondent despite service of notice.

In view of the fact that the benefit of computation of pension had already been taken by the respondent who retired on 28th February, 1993, Office Memorandum dated 27th October, 1997 enhancing the pension which was prospective did not apply to the computation pension.

Accordingly, the impugned order stands modified to the extent that the respondent will not be entitled to the benefit computation of pension as per O.M. dated 27th October, 1997.

The appeal is disposed of in above terms.

Pending applications, if any, shall also stand disposed of.
