The office report was listed before Ld. Registrar Court on 29th October, 2014 when the following order was passed:

"The office report is that although by order dated 12.08.2014 of this Court, four weeks time as last chance was given to the sole respondent No. 17 to file the counter affidavit, yet he has not done the needful so far. Therefore, no further opportunity is warranted to be given to him on that count taking into consideration the rule position.

Service of notice is complete on the respondent Nos. 15,16, 19, 20, 23, 24, 26, 27, 31, 32, 34, 41 & 44, but no one has entered appearance on their behalf. These respondents shall be at leberty to file the counter affidavit within a period of four weeks, in case they intend to do so, whereafter no further extension shall be provided.

The respondent Nos. 6, 10, 17, 25, 30, 4648 have failed to file the counter affidavit within the period stipulated under the rules.

Fresh steps for the service of notice by usual mode to the unserved respondents shall be taken by the Ld. Counsel for the petitioners within a period of three weeks. Dasti in addition is permitted to be served through the Trial Court, the particulars of which shall be furnished by the ld. Counsel for the petitioners within the same period.

List again on 13.01.2015."

It is submitted that Counsel for the Petitioner has not taken fresh steps regarding

service of notice on unserved respondent No. 39.

The office report is listed before the Ld. Registrar Court for orders.
