CORAM :

HON'BLE MR. JUSTICE HRISHIKESH ROY [IN CHAMBER]

For Petitioner(s) Mr. Sharanagouda Patil, Adv. Ms. Supreeta Sharanagouda, AOR

For Respondent(s)

UPON hearing the counsel the Court made the following O R D E R

Mr. Sharanagouda Patil, the learned counsel for the petitioner submits that the petitioner is convicted under Sections 498, 201 & 304 Part-II of the IPC and is sentenced to maximum three years imprisonment.

The counsel next refers to Paragraph 37 of the judgment dated 27.11.2019 in the Crl. A. No. 3564 of 2012 to point out that the petitioner has been in judicial custody for about 15 months from 16.01.2011 to 18.04.2012 (released on bail). Accordingly, it is submitted that since the petitioner was behind Bar for about 15 months, his application for exemption from surrendering should be favourably considered.

Having considered the above, I deem it appropriate to exempt the petitioner from surrendering during the pendency of his case before this Court. It is ordered accordingly. Digitally signed by Rachna Date: 2020.10.06 15:49:49 IST Reason: Signature Not Verified
