Looking to the peculiar facts of the case as the appellant had already paid Rs. 1,14,68,003/- out of demand of Rs. 1,61,39,863/-, no coercive steps shall be taken. In the event of the appellant succeeding in the matter, the said amount shall be returned to the appellant with interest at the rate which may be fixed by this Court.
I.A. No. 2 of 2016 is disposed of in the above terms.

UPON hearing the counsel the Court made the following O R D E R
Looking to the peculiar facts of the case, we direct that by way of interim arrangement, the appellant shall pay a sum of Rs. 4 crores to the respondent-State and in the event of the appellant succeeding in the matter, the said amount shall be returned to the appellant with interest, which might be fixed by this Court. The amount shall be paid within six weeks from today.
No coercive steps shall be taken upon payment of the aforesaid amount.
