The respondent appeared in the Odisha Judicial Service Examination for the year 2013-2014. Aggrieved by his non selection as Civil Judge/Judicial Magistrate, he filed a writ petition in the High Court seeking re-evaluation of Question The High Court held in favour of the respondent $No.12(b)(i)$ . directed re-evaluation of the answer given in Question No.12(b)(i). The High Court further directed that the merit list should be redrawn. While giving such direction, the High Court took note of the fact that there were 69 vacancies for the year 2014.
We are informed that the respondent appeared in the examination conducted in the year 2016 and he was selected and appointed as a Civil Judge.
Though we are in agreement with the judgment of the High Court relating to the re-evaluation of Question No.12(b)(i), we are of the opinion that the direction given by the High Court to redraw the merit list for the examination conducted in the year 2014 cannot be sustained. Any review of the selections conducted in the year 2014 would be detrimental to the interest of candidates selected in the year 2016 and some of those who were selected in the year 2014. The direction given by the High Court to redraw the merit list for the examination conducted in the year 2014 is set aside.
The Special Leave Petitions are disposed of. Pending application(s) stand disposed of.
