This is a transfer petition at the instance of the petitioner-wife seeking transfer of H.M.P. No.297/2016, titled Sri Ajay Kumar S. Singh vs. Smt. Kiran A. Singh**, pending before the court of 4th Jt. Civil Judge Sr. Division, Nagpur, Maharashtra, to the court of competent juridiction at Bokaro, Jharkhand.**
Despite service of notice, respondent has not appeared. Hence, averments made in the transfer petition remain unrebutted.
Having heard learned counsel for the parties and in view of the the hardships which will be faced by the petitioner in contesting the case at Nagpur, Maharashtra, we deem it proper to allow the transfer petition and transfer the aforesaid case from court of 4th Jt. Civil Judge Sr. division, Nagpur, Maharashtra to the court of competent juridiction at Bokaro, Jharkhand, along with all records for its adjudication.
After transfer of the case, the transferee Court is directed to make all endeavour either for amicable settlement or for early decision in the matter without unnecessary adjournments.
