Learned counsel for the appellant submits that pursuant to the order dated 06.12.2021 proof of service through publication in respect of respondent nos.7 and 18 in CA No.6610/2014 and respondent no.7 in CA No.6609 of 2014, 6611 of 2014 and 6612 of 2014 has not been filed.

Mr. Nayab Gauhar, Advocate for the appellant submits that publication has been done in vernacular language and seeks one week time to file proof of the same. His submission undertaking is placed on record. If proof of publication is not submitted appeal stands dismissed against respondent nos.7 and 18 in CA No.6610/2014 and respondent no.7 in CA No.6609 of 2014, 6611 of 2014 and 6612 of 2014 without further reference to the Court.

I.A. Nos. 155792/2021 and 155794/2021

Application for deletion of common respondent no.15 in CA Nos.6609-6612 of 2014 and respondent nos. 23 and 25 in CA No.6610 of 2014 is filed on the ground that they have expired during the pendency of the present appeal. Since the said respondents have expired, question of deletion does not arise. Hence, I.A. Nos. 155792/2021 and 155794/2021 stand rejected and the petition stands abated against Respondent nos.15, 23 and 25.

Accordingly, I.A. stands disposed of.

I.A. No.156512/2021 and 156513/2021

These applications have been filed for substitution of common appellant no.7 viz. Mulagar Singh along with application seeking exemption for filing a notarized affidavit.

The Death certificate of the appellant no.7 is enclosed along with the application which indicates that the date of death is 02.04.2020. The applications stands allowed as there is no resistance to these applications. Hence, both these applications stand allowed.

Amended memo of party be filed within two weeks failing which the appeal shall stands dismissed against common appellant no.7.

The learned counsel appearing for the respondent submits that respondent nos. 4 and 5 in CA No.6609-6612/2014 have expired. His submissions are placed on record. Learned counsel for the appellant to take steps to bring the LRs of the respective respondents on record within 4 weeks from today failing which the appeal against the said respondents stands abated.
