The I.A Nos.35 (application for substitution of deceased respondent No.3 and condonation of delay in filing substitution application and setting aside abatement and exemption from filing O.T) in the matter above mentioned was listed before the Hon'ble Court(In Chambers) on 05.11.2015 when the Court was pleased to pass the following Order :
"None appears to prosecute the I.As., the same are dismissed for nonprosecution."
Thereafter, I.A No. 6 (Application for Restoration of I.A Nos. 35)filed by counsel for the petitioner was listed before the Hon'ble Court (In Chamber) on 9.12.2015 when the court was pleased to pass the following order:
" Order dated 05.11.2015 is recalled. The I.As are restored to its original number."
The matter above mentioned was listed before the
Hon'ble Court(In Chamber) on 18.1.2016 when the Court was pleased to pass the following order :
" Perused the applications. Accordingly to para 7 of the application for substitution, respondent No.3 had expired in the year 1991, his son had also expired in April, 1992 and daughterinlaw in the year 2011. There is no explanation for the delay in preferring the said application. Hence, application for condonation of delay, as also, application for substitution to bring on record the legal heirs of deceased respondent No.3 are dismissed. Consequently, the special leave petition qua respondent No.3 abates and is dismissed as such."
Now Mr. Shekhar Kumar, counsel for the petitioner has on 3.2.2016 filed an applications for recalling court's order dated 18.1.2016 of the Hon'ble Chamber Judge. The same is registered as I.A No. 7.
