Having heard learned counsel for the appellants as also learned counsel for the respondent No.2 and keeping in view the nature of consideration made by the High Court in a claim under section 166 of Motor Vehicles Act after referring to all aspects of the matter, we see no reason to interfere with the judgment.
However, if the appellants have the right in law to claim under any other provision of the Motor Vehicles Act including a claim for `no fault liability', such liberty is left open to the appellants and the Tribunal before which the claim is made, may examine the same on its own merits and in accordance with law.
The appeals are, accordingly, disposed of.
