UPON hearing counsel the Court made the following ORDER

Heard learned counsel for the parties.

While issuing notice on 21st July, 2008, after hearing all the parties, prayer for grant of interim relief was specifically rejected by this Court which would obviously mean that the impugned order passed by the High Court shall be given effect to.

-3- Having heard learned counsel for the parties and perused the records, we direct the Liquidator Board-Godavari Dudhna Sahakari Sakhar Kharkhana Limited and the State of Maharashtra to hand over physical possession of the Sugar Mill, namely, Godavari Dudhna Sahakari Sakhar Karkhana Limited, situated at Devnandra, Taluka Pathri, District Parbhani, to the purchaser, latest by 25th September, 2008.

However, the purchaser is directed not to alienate or in any manner encumber the Sugar Mill in question. The purchaser is also directed not to create any third party right or interest therein.

The interlocutory applications are, accordingly, disposed of.
