1. Leave granted.

2. We have considered the matter and have heard the learned counsels for the parties.

3. It is our considered view that the High Court, in the facts of the case, ought not to have quashed the criminal proceedings in question. As by virtue of the present order the trial will now commence against the accused respondents we refrain from recording our views for the above conclusion. We make it clear that the trial will now proceed and will be concluded as expeditiously as possible. In the course of the trial all defences that may be open may be raised by the accused persons.

4. Consequently and in the light of the above, the order of the High Court is set aside and the present appeals are disposed of in the above terms.
