These IAs have been filed seeking directions from this Court to the Noida/Greater Noida Authority respectively to sanction the building plans/layout plans with reference to unused FAR of the projects of which details will be referred later, originally sanctioned with FAR of 2.75 at the relevant time when the lease deed was executed but that stood later revised from 2.75 to 3.5 (addition of 0.75) R, according to their building regulations.
It reveals from the record that in respect to unused/balance FAR of the present projects in question, which indeed was originally sanctioned by the Noida/Greater Noida Authority at the time when the lease was sanctioned with 2.75 FAR but since it could not have been utilized and remained unused, at one stage, I.A. Nos.141062 of 2019 and 155624 of 2019 were filed by the Noida/Greater Noida Authority seeking direction for release the unused/balance FAR to the respective authorities.
Both the applications came to be rejected by this Court, after detailed discussion by an order dated 10.06.2020 with the following directions :
- (i) The sale of balance FAR shall be available within the Sanctioned Plan;
- (ii) The sale of unused FAR shall be up to permissible limit @ 2.75 or more as available;
- (iii) The sale of FAR beyond 2.75 up to 3.5 under the purchasable scheme or otherwise granted in Dream Valley Project, Plot No. GH09, Tech Zone IV, Greater Noida, and other projects or any increase in FAR beyond permissible/purchasable due to 17 whatever reasons such as the coming up of Metro project are to be sold & transferred under the Authority of Receiver and Committee appointed by this Court.
- (iv) The above direction will be notwithstanding any previous dues of the Amrapali Group, their associate companies/ developers/ other contractors deployed by them, or any other previous/present outstanding.
- (v) The Noida / Greater Noida Authorities or any other Development Authorities, where these projects are situated, will not take into account any cost consideration and will provide additional FAR as may be available due to existing/proposed
metro line and sanction their plans accordingly within a fixed time frame of 30 days after submission of the details and designs.
- (vi) The Noida / Greater Noida Authorities / Public Authorities / Various Service Departments/Authorities like Water/ Power/ Sewage/Pollution etc. shall adhere to the advice/ request of the Receiver appointed by this Court and will consider the same as a direction issued by this Court.
- (vii) With respect to purchasable FAR, if any amount is payable to Noida and Greater Noida Authorities it shall be paid after the sale of the FAR.
At one point of time, the Court Receiver after consultation with the Committee appointed by this Court was of the view that the unused FAR available with the Court Receiver in terms of judgment of this Court dated 23rd July, 2019 may be sold in the open market by public auction to generate funds with an object that the additional revenue received on account of public auction with reference to unused FAR of the project in question may be utilized for completion of the existing projects, but since that was found not feasible and after the scheme was revisited, it was prayed by the Court Receiver after due consultation with the Committee appointed by this Court that let the unused FAR which stood later revised to 3.5 (purchasable FAR of 0.75), be used in reference to the respective projects other than Princely Estate Project in regard to vacant land where the constructions are yet to be raised and their revised building plans/layout plans may meet out the present/existing requirement of 3.5 FAR be sanctioned in terms of the building regulations of the Noida/Greater Noida Authority.
On the last date of hearing, when the matter was taken up by this Court, a specific question was put to the counsel for the Noida/Greater Noida Authority that where the demand has been raised to grant sanction for additional 0.75 FAR in reference to the allotted plot where on property (duly demarcated), any construction has been raised, it is informed to this Court that in each of the projects to which additional FAR 0.75 has been prayed for, no construction has been raised so far and it is admissible (FAR) to the existing allottees as well, provided they fulfil all the necessary requirements under the building regulations of Noida/Greater Noida Authority. It goes without saying that while additional FAR is being claimed which is admissible and permissible FAR, it has to take into account the ground coverage, population density and open space as per the building regulations of the Noida/Greater Noida Authority.
Projects of Noida Authority
(i). Silicon City Project, Plot No.GH01A, Sector 76, Noida – Date of allotment 03.03.2010, date of execution of lease deed 30.07.2010, FAR admissible as per the lease deed 2.75, additional FAR 0.75 is admissible but is a purchasable FAR in terms of building regulations.
At this stage, an objection was raised by Shri Neeraj Kishan Kaul, learned Senior Advocate, that since his clients, SBI Capital Venture Funds (Swamih Funds) has an interest in the project, at least they may be taken into confidence and be made aware of the progress not only at the stage of sanction of plans, but thereafter as well.
We consider it appropriate to observe that let the NBCC submit their revised building plans/layout plans through the Court Receiver, who holds rights of the lessee to the Noida Authority for the purpose of seeking approval/sanction of the plans with the advance copy to the Swamih Funds.
It is also brought to our notice that certain illegal encroachments have been made on part of the plot which have made the project unworkable. It reveals from the record that at least at the time when the allotment was made and the lease deed was executed on 30.07.2010, it was an unincumbered vacant land and who has permitted to make such an encroachment, if any, is not made known to this Court.
In the given facts and circumstances, we deem it appropriate to direct the Noida Authority to take assistance from the local district administration/Police Commissioner, District Gautam Budh Nagar, U.P. and get all the illegal encroachments removed and restore it to
the Court Receiver, free from all encumbrances, without any loss of time at least before the final decision is taken by the Noida Authority for sanction of the building plans/layout plans.
We further make it clear that since this Court is in seisin of the matter, no Court shall entertain any petition/suit in this regard and any person who has an objection, is at liberty to file an application in this Court.
(ii). Princely Estate Project, Plot No.GH02A, Sector 76, Noida – Date of allotment 26,02,2010, date of execution of lease deed 10.06.2010, FAR admissible as per the lease deed maximum 2.75, additional FAR 0.75 is admissible but is a purchasable FAR in terms of building regulations.
An application has been filed on behalf of Solid Properties Pvt. Ltd. bringing to the notice of this Court that unused sanctioned FAR of Princely Estate Project was put to auction on 15.09.2021 with regard to the land admeasuring 8067.70 sq. meters and in the open auction, the applicant was declared the successful bidder and later on, allotment letter was issued under the signatures of the Court Receiver dated 18.09.2021.
Learned counsel submits that since the applicant has infused sufficient money in the project after participation in the open bidding
process which was held pursuant to the orders of this Court, at least he has a right and interest in the project and the building plans/layout plans furnished by the applicant may be sanctioned by the Noida Authority in a time bound manner.
Mr. Ravinder Kumar, counsel for the Noida Authority, submits that this Court has considered the auction which was held in reference to the unused FAR of Princely Estate Project, proceedings are noticed by this Court as it reveals from the order dated 12.07.2022 and the schedule of properties which were auctioned by the Court Receiver have been noticed are detailed as under:

Counsel for the Noida Authority submits that the unutilized FAR pertaining to any piece of land or property has to be used on the vary same piece of land or property and cannot be sold in open market like
a tradable commodity to be utilized on some other piece of land or property and there is a reason for which this Court after noticing his submission has not ratified the auction held and it has to be examined by this Court independently on its own merits.
Counsel further submits that as per the lease deed, the sanction FAR is 2.75 and additional FAR of 0.75 is a purchasable FAR which has to be purchased for which payment has to be made and is not free. Additional FAR has not been purchased so far and the aforesaid is in addition to all other requirements including consent of the existing flat buyers as it would entail construction of larger numbers of flats which would result in shortening the common area, reduction in open area and greens etc. per flat for the existing flat buyers.
Counsel further submits that the demarcated area as claimed of 8,067.70 sq. is not available to the lease holders and that a part subdivided plot shall have an area of not less than 20,000 sq. meters, whereas the proposed area for sale was only 8067.70 sq. meters, which is less than the permissible area for subdivision and such subdivision is not permissible.
Counsel further submits that FAR cannot be purchased for the entire undivided plot and then loaded on to the subdivided portion of the plot as prayed for by the applicant, which is not permissible in
terms of the building regulations.
After we have heard counsel for the parties, we are of the view that once the auction was held under the directions of this Court and auction bid stands finalized and letter of allotment has been issued by the Court Receiver on 18.09.2021 and sufficient funds have been infused by the auction bidder, we find sufficient material on record to ratify the auction which was held under the directions of this Court and so far as the objection raised by the Noida Authority, in the peculiar facts and circumstances of the case, stands overruled.
Accordingly, we direct the Noida Authority to examine the building plans/layout plans furnished by the applicant (M/s Solid Properties Pvt. Ltd.) on merits in terms of their building regulations expeditiously, as possible.
Projects of Greater Noida Authority
(i) Centurian Park Project, Plot No.GH05, Sector TechzoneIV, Greater Noida. Date of allotment 30.09.2010, date of execution of lease deed 17.02.2011, FAR admissible from lease deed maximum 2.75.
It is informed to this Court that SBI Capital Venture Funds (Swamih Funds) has an interest in the project. In the given facts and circumstances, we consider it appropriate let the NBCC submit
building plans/layout plans through the Court Receiver for the purpose of seeking approval/sanction of the Plans, with an advance copy to the Swamih Funds.
(ii) Golf Homes, Plot No.GH02, Sector 04, Greater Noida Date of allotment 23.04.2010, date of execution of lease deed 13.09.2010, FAR admissible from lease deed maximum 2.75.
(iii) Leisure Parks, Plot No.GH01, Sector TechzoneIV, Greater Noida. Date of allotment 23.04.2010, date of execution of lease deed 30.07.2010, FAR admissible from lease deed maximum 2.75.
(iv) Leisure Valley, Plot No.GH02, Sector TechzoneIV, Greater Noida. Date of allotment 06.05.2010, date of execution of lease deed 11.02.2010, FAR admissible from lease deed is maximum 2.75.
(v) Dream Valley, Plot No.GH09, Sector TechzoneIV, Greater Noida. Date of allotment 30.08.2010, date of execution of lease deed 25.02.2011, FAR admissible from lease deed maximum 2.75.
Additional 0.75 FAR is admissible in all the above projects, which is a purchasable FAR as per the building regulations.
Learned counsel appearing for the Greater Noida Authority submits that the additional FAR of 0.75 is although available to the existing allottees as well, but it is purchasable FAR, provided the project proponent fulfil all the terms and conditions of the building
regulations.
In addition, an objection is that for additional admissible FAR (0.75) for which the demand has been raised, it could not have been possible to sanction unless there is a consent from the apartment/owners' association/home buyers.
Mr. M.L. Lahoty, appearing for the home buyers in his note has stated that they have no objection in reference to all the seven projects provided the constructions are raised in the area in terms of the building plans/layout plans to be approved/sanctioned by the Noida/Greater Noida Authority provided all the amenities/ facilities, including the ground area of existing home buyers is not disturbed. This goes without saying that while utilizing 3.5 FAR, the amenities/facilities including the ground area available for the home buyers is always to be protected in terms of the building Regulations.
We consider it appropriate in the facts and circumstances that the NBCC through Court Receiver may submit their respective revised building plans/layout plans of the projects of which a reference has been made taking note of the FAR originally sanctioned 2.75 + additional FAR 0.75(3.50 FAR), for a part of the land (demarcated area) on which no construction so far has been raised within a period of two weeks in the office of Noida/Greater Noida Authority, who may
examine such building plans/layout plans in terms of their building regulations and submit their report to this Court positively within a further period of 15 days thereafter.
IAs are accordingly disposed of.
List the matter for further orders on 25th April, 2023.
