The matter above mentioned was listed before the Hon' ble Court on 13.04.2015 when the Hon' ble Court was pleased pass the following order:
"Issue notice returnable within 10 days. Dasti, in addition, is permitted. Liberty to serve Ms. Hemantika Wahi, learned counsel, who ordinarily appears for the State of Gujarat."
Accordingly show cause notice returnable on 27.4.l2015 was issued to the sole respondent/State of Gujarat through registered A.D. Post on 15.4.2015. A copy of notice was also issued to Ms. Hemantika Wahi ,Standing counsel for State of Gujarat. A copy of dasti notice was also handed over to the Counsel for the Petitioner for effecting service of the notice on the sole respondent/State of Gujarat and to file proof of dasti service.
It is submitted that neither A.D. Card nor unserved envelope containing notice has been received back from the sole respondent.
It is further submitted that Counsel for the Petitioner has on 18.04.2015 filed affidavit with proof of dasti service of the notice on Ms. Hemantika Wahi, Standing Counsel for the State of Gujarat but no one has entered appearance.
Service of Show Cause Notice is complete by way of dasti.
The matter above mentioned is therefore listed before Hon'ble Court with this office report.
