It is submitted to the Hon'ble Court that counsel for the Appellant has on 30th July, 2015 filed an application for restoration of Civil Appeal alongwith application for condonation of delay in filing restoration application as there is a delay of 221 days in filing the application for restoration. The above-said appeal has dismissed for non-prosecution by this Hon'ble Court 20th November, 2014. The same have been registered as IA Nos. 1 and 2 and placed before the Hon'ble Court's kind perusal.

It is further submitted that there are 29 Respondents in the matter above-mentioned. Respondent Nos. 1 and 2 are represented by Mr. Guntur Prabhakar, Advocate. Respondent Nos. 4, 5, 9 to 11, 14, 15, 17, 19 to 21, 23 to 25 stands served at the SLP stage. Respondent Nos. 6, 8, 16, 27 and 28 have been served with the notice but no one has entered appearance on their behalf so far. Notice of Lodgment of Petition of Appeal in respect of Respondent Nos. 3, 7, 12, 18, 22, 26 and 29 have been received back unserved from the High Court with remarks "Transferred" and Respondent No. 13 "died" but counsel for the Appellant has neither furnished the correct and latest address of unserved Respondent nor taken any steps in this respect of deceased Respondent No. 13 so far despite Registry's letter dated 7th August, 2014.

Service is incomplete on Respondent Nos. 3, 7, 12, 13, 18, 22, 26 and 29.

It is further submitted that counsel for both the parties have not filed statement of case so far.

The application above-mentioned are listed before the Hon'ble Judge-in-Chambers with this office Report.
