UPON hearing the counsel the Court made the following O R D E R

The Court is convened through Video Conferencing.

The petitioner has filed this petition against the final judgment and order dated 12.03.2019 passed by the High Court of Madhya Pradesh, Bench at Indore in Criminal Appeal No.1376 of 2008 whereby the Division Bench of the High Court dismissed his Criminal confirming the conviction and sentence passed by the Appeal, learned Additional Sessions Judge, Narsinghgarh, District Rajgarh Baora)in Sessions Case No. 22 of 2007 dated 21.11.2008.

Vide order dated 16.09.2020, notice was issued limited to the quantum of sentence only.

Heard learned counsel appearing on behalf of the petitioner as also the learned Deputy Advocate General appearing on behalf of the respondent – State.

Leave granted.

Having regard to the totality of facts and circumstances of the instant case and keeping in view the fact that the appellant has suffered incarceration for a period of more than 11 years, we are inclined to grant him bail.

The appellant is, accordingly, directed to be enlarged on bail on terms and conditions to be imposed by the trial court.
