The matter above mentioned was listed before the Ld. Registrar Court on 30th October,

2015 when the Court was pleased to pass the following order:

Civil Appeal No. 10301/2014 Ld.counsel for the appellant shall file the statement of case within a period of 45 days and the Ld.counsel for the respondents shall file the same within a period of 35 days thereafter. Civil Appeal No.4037/2015 Four weeks time as last chance is given to the respondent No.16, to file the counter affidavit. Mr.Abhishek Kisku, Ld.counsel on behalf of Mr. Anirban Bhattacharya, Advocate has stated that he does not need to file the counter affidavit on behalf of respondent Nos.13,21,30 & 47. This is taken on record. Four weeks time as last chance is given to the Ld.counsel for the petitioner to comply with the terms of the order dated 13.08.2015 of this Court in respect of the unserved respondents. List the matter again on 19.01.2016."

It is submitted that Statement of Case has not been filed by any of the parties in the matter so far.

CIVIL APPEAL NO. 4037 OF 2015

Service on respondent no. 16 is not complete. Mr. Rupesh Kumar,Advocate has entered appearance on behalf of respodent no. 73 but has not filed counter affidavit.

It is further submitted that Respondent nos. 77,76,39,73,47,29,67,78,21,74 are common in both the matters and are represented by their respective counsels in Main matter C.A. No. 10301 of 2014. Respondent nos 10,13,17 and 18 in Appeal No. 4037 of 2015 are common with Respondent nos. 9,12,16,17 in Appeal no. 10301 of 2014 which are represented by their respective counsels. Certificate of Service is awaited for the remaining respondents. Counsel for the appellant has on 14.01.2016 filed fresh particulars of the respondent Nos.8,16,28, 59,10,12,26, 11,44, 22,77,80,65,68 and 79 but has not filed spare copies of the petition, hence fresh notice in the matter to these unserved respondents could not be issued.

The matters abovementioned are listed before the Ld. Registrar Court with this Office Report.
