The Learned counsel for the respondent Nos. 17 and the Ld. Counsel for the respondent No. 77 seek and are given four weeks' time to file the counter affidavit. The other served respondents shall also be at liberty to file the counter affidavit within the period stipulated above. Dr. Richa Awashthi, Ld. Counsel shall within a period of four weeks comply with the terms of the office report, failing which appropriate orders shall follow on the next date. C.A. No. 4037/2015 The learned counsel for the appellant shall within a period of four weeks file the fresh particulars of the respondent Nos. 8,16,28, 59,10,12,26, 11,44, 22,77,80,65,68 and 79 and he shall also take appropriate steps for the service of notice to them within the same period. The served respondents shall be at liberty to file the counter affidavit within a period of four weeks. Await the return of the service of notice already issued to the unserved respondents. List again on 30.10.2015.

It is submitted that Counsel for respondent no. 17 has not filed counter affidavit. Counsel for respondent no. 77 has filed reply affidavit and Counsel for respondent no. 9 has filed counter affidavit. Dr. Richa Awasthi, have not filed vakalatnama and counter affidavit on behalf of respondent no. 79. Counsel for respondent no. 55 and 73 have filed counter affidavit. Service is complete in the matter.

CIVIL APPEAL NO. 4037 OF 2015

It is submitted that Mr. Anirban Bhattacharya, Advocate has entered appearance on behalf of respondent nos. 21,30,13 but has not filed counter affidavit. Mr. E.C. Agrawala,Advocate has entered appearance on behalf of respodent no. 60 but has not filed counter affidavit.

It is further submitted that Respondent nos. 77,76,39,73,47,29,67,78,21,74 are common in both the matters and are represented by their respective counsels in Main matter C.A. No. 10301 of 2014. Respondent nos 10,13,17 and 18 in Appeal No. 4037 of 2015 are common with Respondent nos. 9,12,16,17 in Appeal no. 10301 of 2014 which are represented by their respective counsels. Certificate of Service is awaited for the remaining respondents. Counsel for the appellant has not filed fresh particulars of the respondent Nos.8,16,28, 59,10,12,26, 11,44, 22,77,80,65,68 and 79 and have not taken steps in view of the above said orders.
