After hearing learned counsel for the parties, we do not find any reason to interfere with the impugned order passed by the High Court at this stage.

The appeal is, accordingly, dismissed.

However, we give liberty to the appellant to file a review petition before the High Court for referring the matter to the Collector to decide the quantum of penalty that should be levied upon by the appellant, within one month. -2-
