It is submitted for the information of the Hon'ble Court that the instant matter has been filed against the Judgment and Order dated 30.07.2014 of the High Court of Delhi at New Delhi in Writ Petition(C) No. 2357 of 2014 alongwith application for condonation of delay in filing SLP (barred by time by 483 days) (regd. as I.A. No. 1) and application for exemption from filing certified copy of the impugned order (unregistered) and the same has been included in SLP paper books.
It is further submitted that SLP(C) No. 7100/2009 referred to on page 'N' of list of dates was listed before the Hon'ble Court on 25.02.2010, when the Court was pleased to grant leave. Consequently Civil Appeal has been registered as C.A. No. 2299/2010. Copy of order dated 25.02.2010 is enclosed herewith.
It is further submitted that the instant matter respondent has filed caveat on behalf of caveator as in-person alongwith application for permission to appear and argue in-person (regd. as I.A. No. 2). The said application was placed before the Ld. Registrar (Misc.) for interaction with
the petitioner-in-person as provided under Order IV Rule 1(C), Supreme Court Rules-2013, when the Ld. Registrar (Misc.) pass the following order:-
"It is respectfully submitted that Mr. Vinay Kumar appeared before the undersigned today as Respondent-in-person. The undersigned interacted with the Respodnent-in-person from which it transpires that he knows English and will be able to argue and address the Hon'ble Court in an appropriate manner and will be able to render necessary assistance to the hon'ble Court for the proper disposal of the instant matter. He does not intend to avail the services of an Amicus Curiae. Report is submitted accordingly."
It is lastly submitted that notice of hearing for 09.05.2016 to Respondent-in-person was sent on 09.04.2016 by speed post. As per postal tracking report, notice has been delivered on 11.04.2016.
The matter alongwith application above-mentioned is listed before the Hon'ble Court with this Office Report.
