1 Mr K V Viswanathan, senior counsel appearing on behalf of the petitioner, submits that while the High Court has quashed the charges which were framed under Section 13(2) and 13(1)(d) of the Prevention of Corruption Act 1988 (for want of sanction under Section 19), the prosecution has been allowed to proceed in respect of the charges which have been framed under Section 120B read with Sections 420, 408, 477A, 471 and 201 of the Indian Penal Code 1860.   • 2 Since the submission is that the High Court has not considered the issue of sanction under Section 197 of the Code of Criminal Procedure 1973, all that needs to be clarified is that it would be open to the petitioner to raise the defence before the trial court which may be considered in accordance with law.
