UPON hearing the counsel the Court made the following O R D E R

Delay condoned.

Mr. Neeraj Kishan Kaul, learned Senior Counsel, has stated at the Bar that he has instructions to appear on behalf of respondent No.2 – Govind Iyengar in D.No.8718/2023, who is also respondent No.10 in D.No.9557/2023, only. Learned Senior Counsel further submits that he is not appearing on behalf of the other respondents against whom also the criminal proceedings are quashed by the High Court.

Having heard Mr. Sidharth Luthra, learned Senior Counsel appearing on behalf of the petitioner/original complainant as well as Ms. Garima Prashad, learned Additional Advocate General appearing on behalf of the State of Uttar Pradesh and taking into consideration the relevant materials on record, which suggest that many of the respondents against whom the criminal proceedings are quashed by the High Court were even part of the many important committees and even respondent No.2 – Govind Iyengar in D.No.8718/2023, who is also respondent No.10 in D.No.9557/2023, was the Vice-President and even was the authorised officer of the company under the Companies Act.

Issue notice for final disposal, returnable on 24.04.2023.

Mr. Neeraj Kishan Kaul, learned Senior Counsel, accepts notice on behalf of respondent No.2 – Govind Iyengar in D.No.8718/2023 and respondent No.10 in D.No.9557/2023.

For rest of the respondents, dasti, in addition, is permitted. The concerned respondents be served within a period of four days from today.

It will be open for the concerned respondents to file the counter affidavit on or before the next date of hearing.
