Respondent Nos. 1 to 3 have already filed the counter affidavit. None appears for respondent No. 4, despite due service.

The Ld. Counsel for the petitioner to take fresh steps for service of respondent No. 5 within two weeks' time. Notice thereafter be issued.

SLP(C) NOS. 28586 and 28584/2016

Respondent Nos. 1 to 3 have already filed the counter affidavit. List again on 3.4.2017"

It is submitted that Counsel for the Petitioner has not taken fresh steps for service of Respondent No. 5 hence, notice could not be issued.

It is further sumbitted that no one has entered appearance on behalf of Respondent No. 4 so far. Service is not complete in Respondent No. 5

SLP(C) Nos. 28586 & 28584 of 2016

It is submitted that M/s. Mitter & Mitter Co., Advocates have on 2nd March, 2017 filed Vakalatnama and Memo of appearance on behalf of Respodent No. 4 in SLP No. 28584 of 2016 but have not filed Counter Affidavit so far..

It is further submitted that no one has entered appearance on behalf of Respondent Nos.

4 & 5 in SLP No. 28586 of 2016 so far. Service is complete in both matters.

The matters abovementioned are listed before the Ld. Registrar Court for orders.
