In view of the above, notice need not be issued to respondent No.1.
Notice to the remaining respondents be issued returnable on 17.02.2012. Dasti, in addition, is permitted.
Affidavit on behalf of respondent No.1 may be filed
within four weeks. Two weeks for further affidavit, if any, on behalf of the petitioner.
Till the next date, the status quo regarding possession, as it is obtaining today, shall be maintained. This would necessarily mean that neither party shall change the present character of the property nor alienate the same to any other person in any manner whatsoever.
It shall be the petitioner's duty to serve the remaining respondents before the next date of hearing failing which the interim order passed today shall stand automatically vacated.
