"Delay condoned. Learned counsel for the petitioner submitted that the petitioner has already honoured the claim of the respondent No. 1 till 1984. Notice on the question whether the respondent No. 1 is entitled to raise his claim beyond."

Accordingly, show cause notice was issued to both the respondents through Registered A.D. Post. Dr. Kailash Chand, Advocate has filed vakalatnama and counter affidavit on behalf of Respondent No. 1. Copy of counter affidavit has been included in the SLP paper books.

It is further submitted that respondent No. 2 is also respondent No. 2 in SLP(C) No. 11992 of 2014 and has been served through Trial Court.

The matter above mentioned was listed before the Hon'ble Court on 25.04.2014 when the Court was pleased to pass the following order :

"Delay condoned. Issue notice. Tag with Special Leave Petition (Civil) No. 6940 of 2014."

It is submitted that accordingly show cause notice was issued to both respondents. Respondent No. 2 has been served through the concerned Trial Court but no one has entered appearance on his behalf so far. Respondent No. 1 is the petitioner in SLP(C) No. 6940 of 2014(Main Matter) and represented through Mr. Rahul Gupta, Advocate.

Service of show cause notice is complete.

The matters above mentioned were lastly listed before the Ld. Registrar on 13.05.2015 when the interalia following order was passed :

"SLP(C) No. 6940/2014

The office report indicates that the Respondent No.1 has already filed the counter affidavit.

The office report further is that service of notice is complete on the respondent No.2 but no one has entered appearance on his behalf. Viewed, in that context, the matter shall be processed for listing before the Hon'ble Court, under the rules.
