4. Having heard learned senior counsel for the parties, we find that these appeals are covered by a decision of this Court dated 16.02.2024 in Mallamputi Ratnamma (Died) By L.R. vs. The Special Deputy Collector (Land Acquisition) rendered in C.A. No.2557/2024.

5. The instant appeals are, accordingly, allowed strictly in terms thereof and the appellants are held entitled to compensation at the rate of Rs.3,000/- per Pomegranate Tree. The enhanced amount shall be paid within 10 weeks.

10. There is no doubt that in view of the order passed by this Court dated 16.02.2024 in Mallamputi Ratnamma (Died) By L.R. vs. The Special Deputy Collector (Land Acquisition) rendered in C.A. No.2557/2024, the expropriated land owners, like the appellants, are entitled to compensation at the rate of Rs.3,000/- per Pomegranate tree. A dispute, however, has arisen:

(i) Whether the fruit-bearing trees (Pomegranate trees) were actually there or not?

(ii) If so, how many such trees per acre have been acquired?

Both being questions of fact, we allow these appeals in part and remit the case to the Reference Court-cum-Land Acquisition Court at Nellore District to determine both questions, after giving a reasonable opportunity of being heard to the parties. It is made clear that no objection of limitation etc., shall be entertained. If it is found that there actually were Pomegranate trees, at the time when the land was acquired, the appellants shall be entitled to compensation strictly in terms of the order passed by this Court in Mallamputi Ratnamma case (supra). The Reference Court shall determine both questions within a

period of six months. While assessing the compensation, the Reference Court shall keep in mind the denial of interest on the delay period as observed by this Court in paragraph 5 of the cited decision.
