Learned counsel for the parties will file a chart indicating the pay scale for the different posts in the Department of Forests, prior and post the enforcement of the 5th Central Pay Commission recommendations. The case made out by the learned counsel for the petitioner is that the respondents were given benefit of the replacement pay scale pursuant to the implementation of the 5th Central Pay Commission Report w.e.f. Further, the respondents, on consideration by the Anomalies Committee, have been given the benefit of upgraded pay scale, which has been made applicable w.e.f. 06.11.2003.
Since there is a dispute as to the actual factual position, it will be appropriate if the parties would file an affidavit clarifying the factual position within a period of three weeks.
