This is an unfortunate case where the petitioner 2 will not be entitled to family pension as her husband who was a casual labourer was not a "Railway Servant". It is

stated by the learned Additional Solicitor General appearing for the respondents that the petitioner has been appointed on compassionate ground as Safaiwali in the Railway Hospital. It is hoped that the petitioner will be continued in such service.
